Koninklijke Philips N.V., registered at High Tech Campus 5, 5656 AE Eindhoven, The Netherlands and/or affiliates to which this notice applies to, wants you to be familiar with how we collect, use and disclose information. This Privacy Notice describes our practices in connection with information about health care professionals that we process through websites operated by us from which you are, through the software applications made available by us or through computers and devices, or when otherwise you interact with us.

 

If you use Philips services as part of an entity or organization that has an agreement with Philips (like your employer or a university), the terms of that organization’s contract for the Philips services identifies how Philips processes personal data uploaded into Philips’ services accounts on behalf of that entity or organization.

What Personal Data are collected?

 

Personal Data” are data that identify you as an individual or relate to an identifiable individual, including:

 

  • Name;
  • Address;
  • Communications preferences;
  • Organizational or institutional affiliations;
  • Telephone number; and
  • Email address

 

We need to collect Personal Data in order to allow you to facilitate the services “my ultrasound” App (The App). If you do not provide the information that we request, you may not be able to benefit from the provisions of our services.

We use cookies, tags or similar technologies to operate, provide, improve, understand, and customize our Services. Cookies allow us to recognize your mobile device and collect your personal data including your unique user Device number, the IP address of your mobile device, the type of mobile internet browser or operating system you use, session and usage data, or service-related performance information, which is information about your use of the “my ultrasound” App.

How are Personal Data collected?

 

We and our service providers collect Personal Data in a variety of ways, including:

 

  • Through the use of “my ultrasound” App: We collect Personal Data through the App, e.g., when you sign up to create an account or actions related to your activity via audit logs; when you send us a message via contact form; when you send us your Feedback on the app using “Feedback” button or answering to the in-app survey;

 

If you disclose any Personal Data about other people to us or to our service providers in connection with “my ultrasound” App, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Notice.

What is the purpose of the collection of Personal Data?

 

We may use the information collected through “my ultrasound” App for the limited purpose of providing the “my ultrasound” App related functionality and services for which Philips has been contractually engaged and/or to comply with a legal obligation. The information may be used to perform a variety of purposes, including to:  

 

• Providing the functionality of “my ultrasound” App and fulfilling your requests;

• Engaging in support operations;

• Facilitating training and educational program; and

• Providing you with our newsletter and/or other marketing materials with your prior consent.

With whom are Personal Data shared?

 

We disclose your Personal Data:

 

• To our affiliates for the purposes described in this Privacy Notice;

• To our third party service providers who provide services such as website hosting, data analysis, information technology and related infrastructure provision, customer service, auditing and other services;

We also use and disclose your Personal Data as necessary or appropriate, especially when we have a legal obligation or legitimate interest to do so:

 

• To comply with applicable law.

 

• To respond to requests from public and government authorities.

If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “How can you contact us?” section below.

What are your rights?

If you would like to:

 

  1. ask questions about how we handle Personal Data;
  2. request to review, correct, update, suppress or restrict the use of your Personal Data;
  3. request that your Personal Data be removed from our database;
  4. withdraw your consent to our use of your Personal Data, without affecting the lawfulness that use prior to this withdrawal;
  5. object to our use of Personal Data for direct marketing purposes or for our legitimate business interests, or
  6. request to receive an electronic copy of your Personal Data for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law),

You can prevent the collection and use of data (cookies and IP address) if you opt-out through link provided in the Edit Profile page.

 

In your request, please make clear what Personal Data you would like to have changed, whether you would like to have your Personal Data suppressed from our database, or otherwise let us know what limitations you would like to put on our use of your Personal Data. For your protection, we only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

 

If you exercise these rights you can continue to use the app as an anonymized user, but you will no longer be able to submit requests or view information that is tailored to your specific interests.

 

Please note that we need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make product or promotion inquiry, you are not be able to change or delete the Personal Data provided until after the completion of such inquiry). There may also be residual information that will remain within our databases and other records, which will not be removed.

How long will the Personal Data be kept?

 

We will retain your Personal Data for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include: (i) the length of time since the last app usage (6 months); (ii) whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

Jurisdiction and cross-border transfer

 

Your Personal Data can be stored and processed in any country where we have facilities or in which we engage service providers, and by using “my ultrasound” App you consent to the transfer of information to countries outside of your country of residence, including United States, Canada, India, which can have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Data.

 

If you are located in the EEA, your Personal Data can be transferred to our affiliates or service providers in non-EEA countries that are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (the full list of these countries is available here: http://ec.europa.eu/justice/data-protection/international-transfers/adequacy/index_en.htm. For transfers from the EEA to countries not considered adequate by the European Commission, we have put in place adequate measures, such as our Binding Corporate Rules for Customer, Supplier and Business Partner Data and/or standard contractual clauses adopted by the European Commission to protect your Personal Data. We may change this Privacy Notice. The “LAST UPDATED” legend at the top of this Privacy Notice indicates when this Privacy Notice was last revised. Any changes will become effective when we post the revised Privacy. Your use of the “my ultrasound” App following these changes means that you accept the revised Privacy Notice.
